TAMPA — The pornographer tried to apologize.

His voice shook. He sounded as if he'd cry.

"I didn't realize I'd made a mistake," Hollywood hardcore producer Paul Little told the judge Friday. "My entire life I've been trying to do the right thing by people and by the law."

Senior U.S. District Judge Susan C. Bucklew interrupted him.

"Mr. Little, I find this almost incredible," she said. "You seem to look at this whole thing as a big joke."

Bucklew sentenced the man known as Max Hardcore to 3 years and 10 months in federal prison for selling and distributing his messy, sometimes violent videos in Tampa. She also made him forfeit three Web sites, fined him $7,500, ordered him to face three years of probation after his prison sentence and fined his company, Max World Entertainment, $75,000.

Tampa jurors convicted Little in June on 10 counts of selling obscene material on the Internet and 10 counts of shipping it to Tampa through the U.S. mail.

They reached that decision after watching 8 1/2 hours of extreme porn on a giant screen in court. At times, they winced as Little performed in sex scenes that included urinating and vomiting.

After nearly two weeks of trial and roughly 12 hours of deliberations, jurors decided that what they had seen went beyond the Tampa Bay region's community standards.

Little's attorneys, who argued his films were protected by the First Amendment, said they plan to appeal.

Little, whose net worth was determined by the government to be near $1.4-million, said his business has suffered since his conviction in June.

"It's cost me just about everything I've made," he said. "All of my money is gone. I've suffered a great deal here."

"Are you saying you're not in business?" Bucklew asked.

"I'm barely in business," he said. "It's on life support."

Little apologized for offending the people of Florida.

"This is completely brand new," he said. "For many years we've made our movies thinking they were completely legal."

Bucklew's sentence was on the low end of the federal guidelines used in such cases. Little faced up to 57 months in prison, and the recommended range for fines was between $1.2- and $2.4-million.

"That would appear to be relatively reasonable under the circumstances if you assume that there is any crime for which he should have been sentenced at all," said Eric M. Freedman, professor of First Amendment law at Hofstra University, who wasn't involved with the trial.

Freedman said it's rare that obscenity cases make it to trial, and sentences vary.

A Colorado porn magnate convicted of federal obscenity charges was sentenced in 2006 to 13 months in prison and ordered to close his adult stores in Texas. A federal judge in 2005 sentenced a Florida man to five years in prison after he pleaded guilty to conspiring to distribute obscene videotapes. An Arkansas man this year was sentenced to 14 months and fined $2,000 after he pleaded guilty to attempting to transfer obscene material to someone yunger than 16.

Federal prosecutors wished to send a message to the purveyors of this type of pornography, at a time many small producers are pioneering new material with new technology.

"It becomes a race to the bottom, fueled by the vastness, the speed and the anonymity of the Internet," said Edward J. McAndrew, an assistant U.S. attorney.

What I find disturbing, regardless what Max Hardcore produced. The fact they they took the time to convict someone like him. His porno was not of my taste, and don't believe I've never seen any of his material, heard of it. All of this is part of the political struggle that that has been festering since the right wing conservative government has taken rein in the USA for at least the past 8 years - the internet, has been a battle ground, where the line has been drawn, and people like Max Hardcore are only pawns. Like television: internet is the same, if you find the material offensive, don't buy or view it. It's obvious it was popular.

Then there is the 'right to free speech' regardless what it is, it's your right to express it - Max Hardcore, may have find behind this blanket, exploiting it to the fullest - that is no nor here or there. The fact remains, that with government - it's one more piece that has been chipped away, in law and politics, it soon or later becomes a chain reaction. Because when they remove all the Max Hardcore's off the face of the earth, they will come after some one else, for less offensive charges - it's an on going struggle, that has to be defended - regardless. People like Hugh Hefner, Bob Guccione and Larry Flynt faught the system tooth and nail, that is the reason we have so much liberty on TV and the internet - people like Paul PT Thomas can testify to the horrors of corrupt political power that hind behind justice, where you can be dragged out of bed in the middle of the night and basically kidnapped across state lines, because your material is deemed offensive on the other side of the country - we as viewers have to take responsibility - if it offends you don't purchase or view it. If it's our ****ren we worry of, well today there is many way of protecting them from the internet, it just needs some eduction on the media. And for those who have been physically hurt and exploited by Mr. Hardcore, there are courts to deal with that too. Freedom is a precious thing, we can't allow, government to mingle in our private lives, god knows our world and our privacy is shrinking by minute.

I don't like his 'work' at all. In fact I totally dislike it and don't watch a minute of it . But should he be put to jail? If so why????? Because of things we don't know about?? I mean, as far as I know, he worked with woman of legal age that knew what they were getting into. I once saw a documentary about a female pornstar that came into contact with Max. It wasn't pretty for sure.... He has a name in the world of porn, everybody knows what he is about. If you don't like it, dont watch it! But putting him to jail?? For what??

I suspect the only fallout of this will be for the poor guys trying to order porn with a Florida zipcode.... bet more than a few companies think twice about it, although Max was WAY over the line.

That is shocking news, I had not heard of this yet. Seen a few of Max's videos, the early ones weren't so "over the top" the last ones I saw were a bit too much for me...

Not that I've seen much of what Max produced, but I think it got to the point where the authorities decided they needed to do something about him. The legal aspect of sending porn through the post was generally overlooked if it wasn't so bad, like in his early days, but he got more extreme with his models and I think that's what caught the attention of the authorities.

The few early ones I saw some years ago were getting towards the extreme level but could have been considered consensual between him and the model. The last few years have shown models wondering what's happening to them at times (there are a few models who enjoy that sort of experience but not many).

I think the authorities have decided it's time to protect the models (unofficially) from the guys who want to abuse them in the way Max did. I don't think they want to eradicate the industry as it's a big money (and tax) earner. What they did was to pick on the main abuser of models and send the message to everyone that what he did was not acceptable. I don't think it'll have serious consequences for the industry, only for those like Max who subject models to experiences they don't expect. The charge of sending illegal stuff through the post was just the way they chose to get a conviction with the hidden agenda of stopping his abuse of women.

Or is it the fact that it looks like abuse?

I've seen a max hardcore video only once and it is too extreme for me. I was wondering to myself "Is this chick really going along with this? Is she drugged?"
Anyways, I wonder if he got off easy if he didn't drug some of those girls.

Abuse from Max H? From what I know it’s a certainty for models he ‘used’.

As some of you know, I’m a good friend with Melissa Ashley. Max had been after her for several years to perform with him and she had rejected the offers knowing his ways. Finally she agreed with agreements in the contract about what she would and wouldn’t do – things like facial peeing were specifically excluded.

On the day he did things that were specifically excluded in their contract. She carried on with the shoot but felt abused. She had been performing for over 5 years by then and so was a seasoned performer and knew the ways of the industry. Max was over the top in doing things outside their pre-performance agreement.

Many of the other girls who worked for him were probably much less experienced in the industry and knew little about what he actually wanted from a model. If Melissa, as a well informed and prepared model, found she was subjected to abuse from him, what of the others?

What can a model do after enduring Max’s abuse – not a lot. Apart from the fact that some have spent the money on cocaine or whatever, the cost of hiring legal representation and publicly admitting to being in the porn industry stops any model from raising a case against him.

Did he drug the girls – I don’t think so. I think he found some who had bad habits and made them an offer they couldn’t refuse. He paid a lot when he had to to get a girl he wanted. If he really wanted them he’d raise his price until they agreed. But for most it was a good amount he offered first and they accepted. Those on drugs tend to be easy bait as they need money quickly. The professionals who have been seduced like Melissa, Kitty, Camilla and Anne Harlow have found his promises have been more that they expected.

IN ADDITION TO MY OWN PERSONAL EXPERIENCE(HE DID NOT INSULT ME) NO GUY SHOULD EVER DO WHAT HE DID TO EVEN ONE WOMEN, LET ALONE THE NUMBER OF WOMEN HE DID THAT TO, AND THEN FILM IT AND MAKE MONEY FROM IT.
