Its legal as long as you obtained it legally. In no way did you breach her right to privacy etc etc. Its ok to film someone over the fence, but you cant do it through their window etc etc. Strange laws and they do vary from country to country

So if she knew i was filming and even talked to the camera and played up for the camera, it would be ok to sell it?
Would that still count if she didn't want me to "publish" it now?

Im no legal expert but I would think that if knew and gave permission for you to film her she would have to expect that you now have ownership. She could always assert some right to privacy but honestly I dont think that flies in this day and age with all the stuff floating round the net.

Shouldn't you be thinking about more than just the legalities and the money you can make?

I mean even if this girl/celeb willingly posed for your camera, there's a massive difference between her thinking it was just a bit of playful fun and you making the stuff public. Could it ruin her life? Please get her permission first. Maybe talk her into it and suggest it's a quick way to more fame. Offer to share the proceeds. I just suggest that you think how you'd feel in her position before you do anything.

I understand but lets just say i'm not too worried about what she thinks now and some might say she even deserves it.
My aim wouldn't be that though but to make some money (if i'm brutally honest).

Unless you have some sort of written release with her signature, I wouldn't do it. I think it would open up too many possibilities to getting sued.
